State Asks for Dismissal of “Fetal Heartbeat” Legal Challenge

LITTLE ROCK, AR – Attorney General Dustin McDaniel says a lawsuit challenging the state’s new “fetal heartbeat” law should be tossed out.

The state responding Tuesday to a federal lawsuit filed by the ACLU on behalf of two Arkansas physicians challenges the legality of the 12-week abortion ban passed during the legislative session.

In a four-page motion to dismiss, attorneys for the state say plaintiffs have no standing to challenge the new law because doesn’t go into effect until August.
